Drones for property images: what the law requires in Portugal

In Portugal, anyone using a drone with a camera must be registered as an operator with ANAC, fly within the open-category rules and respect restricted zones. For professional use, also confirm insurance.

Operator registration

Registration is required when the drone weighs 250 g or more, or when it has a sensor able to collect personal data, such as a camera. This means that a drone under 250 g, like those in the Mini series, also needs registration if it has a camera. Registration is done on the ANAC platform with the Chave Móvel Digital (the Portuguese digital key), the operator number must be displayed on the drone and it must be renewed every three years.

Open-category rules

• Always fly with the drone in sight.
• Respect the maximum height of 120 metres above the ground.
• Fly in uncontrolled airspace, or within what protection zones allow.
• Comply with published geographical restrictions, such as areas near airports.

People and privacy

Even with light drones, you should not fly over gatherings of people. Images in which people or neighbouring houses can be recognised are personal data, so plan the flight to avoid them.

Insurance

National law requires third-party liability insurance for aircraft above 900 g. Below that, it is strongly recommended, especially for commercial use, and many clients will ask for it. Check with ANAC and your insurer what applies to your case.

• Their ANAC operator registration number.
• Third-party liability insurance.
• Confirmation that the site allows flying.
• A flight plan that avoids people and neighbouring properties.

Checklist before the flight

• The operator registration is valid and the number is on the drone.
• The location has been checked against restricted zones.
• The weather allows safe flying.
• There are no people or neighbouring properties underneath the flight.
• Insurance is confirmed for the work in question.
• The property owner has authorised the images.
